russia got into UN Security Council through direct deception and falsifications — lawyer

An expert emphasizes that the Russian Federation is not, and has never been, among the permanent members of the UN Security Council.

Lawyer Maksym Baryshnikov and I spoke about whether Russia is really a permanent member of the UN Security Council and based on which documents.

Maksym Baryshnikov: I have no questions about whether the Russian Federation is a member of the UN or a permanent member of its own separate body of the UN Security Council.

The 3rd and 4th articles of Chapter II of the UN Charter (which is the Constitution of this world’s largest international organization) clearly define that, to become a member of the UN, at least one of the following conditions must be met:

  1. To be among the signatories of the agreement concluded in San Francisco in 1945.
  2. Article 4 includes 2 conditions. First, a state must accept and carry out the obligations of the Charter. This includes respecting the Status of the UN, not wage aggressive wars, and recognize the internationally recognized borders of countries — both of which the Russian Federation has never complied with.
  3. Secondly, the decision on joining the UN is made upon recommendation of the Security Council and by capturing the majority of votes of the General Assembly.

This never happened.

This is regarding Russia’s membership in the UN. Unlike Russia, Ukraine was among the signatory countries of the San Francisco Agreement, and thus, it is among the founding countries of this organization.

If we are talking about the UN Security Council, then it is a bit more complicated, because according to Article 23 of the same Charter there is a status of permanent and non-permanent members. This structure of membership dates back to the time of the League of Nations.

Article 23 states that 5 countries are permanent members of the UN Security Council, and they are named in the text. All others can acquire the status of non-permanent members. Among these 5 countries, there are two that do not exist: the Republic of China and the USSR.

With the Republic of China, the issue was resolved by two votes, accordingly in 1961 and 1971, when the delegation of one China was replaced by another China. However, the question of the Russian Federation was never considered by the UN as there was never a vote.

Accordingly, if we look at the 23rd article, then there is no Russian Federation among the permanent members of the UN Security Council and never was.

According to me and other colleagues from different countries of the world, the Russians got there by direct deception and falsification.
